Second District Appellate Court upholds McHenry County trial court’s granting petition for Indemnity

Indemnity Fund cases are common in Cook County, but not as much in the collar counties and downstate counties. However, that is starting to change. The Second District Appellate Court upheld the McHenry County trial court’s granting of a petition for Indemnity Fund relief. The trial court found that the petitioner had justifiably relied on his deceased father’s caretaker to pay the taxes and that petitioner thus sustained the loss without his own fault or negligence.
